How do I know if I can subdivide?

The subdivision and use of land is controlled by rules in the local District or Regional Council plans. 

To determine whether your property meets the rules requires access to those planning documents, access to a copy of the Resource Management Act, and an understanding of how these documents work together. Fortunately, local Councils publish their Planning documents on their websites and are also available in most public libraries. Likewise the Resource Management Act is freely available for reading on the website.

However neither of these documents are light bedtime reading. Local Councils usually provide duty planners to assist with general enquiries, and you can usually make a booking to discuss your property with a duty planner. They will be able to tell you what zone your property is in, and what the rules for subdivision are in that zone. After that meeting you should know that either you may be able to subdivide, or you can possibly subdivide, or that you probably cant subdivide. At this point, your best advice is to contact a professional who can help.
